REFUNDS AND RETURNS POLICY

1. SCOPE AND APPLICATION

1.1. This Refunds and Returns Policy (“Policy”) applies to all purchases made through the online store operated on Noticias de Nueva Esparta (the “Site”), including our WooCommerce-powered storefront, by Guaripete Solutions INC (“Company,” “we,” “us,” “our”). This Policy covers:

(a) Physical goods (e.g., merchandise, apparel, printed materials, or other tangible products) purchased through the Site and shipped domestically or internationally; (b) Digital goods (e.g., ebooks, PDFs, downloadable media, digital archives, or other electronically delivered content); (c) Digital subscriptions or premium membership tiers, if offered; (d) Advertising and sponsored content placements; and (e) Any other product or service sold through the Site’s store.

1.2. This Policy is incorporated by reference into, and should be read together with, our Terms and Conditions. In the event of a conflict between this Policy and the Terms and Conditions solely with respect to payment, refund, return, or cancellation matters, this Policy shall control.

1.3. Free content, including standard news articles, editorial content, and unpaid comment participation, is provided at no cost and is not subject to any refund, as no payment is made in connection with its access.


2. PHYSICAL GOODS — RETURNS AND EXCHANGES

2.1. Return Window

You may request a return or exchange of an eligible physical product within thirty (30) calendar days of the delivery date shown by the carrier’s tracking information. Requests submitted after this window will not be accepted, except where required by applicable law.

2.2. Eligibility Conditions

To be eligible for a return, the item must be:

(a) Unused, unworn, and in the same condition in which it was received; (b) In its original packaging, with all tags, accessories, and included materials; and (c) Accompanied by proof of purchase (order number or receipt).

2.3. Non-Returnable Items

The following categories are not eligible for return or refund, except where the item is defective or materially not as described (see Section 4):

(a) Perishable goods; (b) Personalized, made-to-order, or custom-printed items; (c) Items marked “final sale” or “clearance” at the time of purchase; (d) Gift cards or store credit; and (e) Digital goods, as governed separately by Section 3 below.

2.4. How to Initiate a Return

To initiate a return, contact us at [email protected] with your order number, the item(s) you wish to return, and the reason for the return. We will provide instructions, including the return shipping address and, where applicable, a return authorization number. Items returned without prior authorization from the Company may be refused or delayed.

2.5. Return Shipping Costs

(a) If the return is due to our error (wrong item shipped, defective product, or damage in transit), the Company will cover return shipping costs and, where applicable, provide a prepaid return label.

(b) If the return is due to a change of mind, incorrect size selection, or any reason not attributable to the Company, the customer is responsible for return shipping costs, including for international orders. We recommend using a trackable shipping method, as the Company is not responsible for items lost or damaged in transit back to us.

2.6. Refund Processing for Physical Goods

Once a returned item is received and inspected, we will notify you of the approval or rejection of your refund. Approved refunds will be issued to your original method of payment within ten (10) business days of approval. Original outbound shipping charges are non-refundable unless the return is due to our error.

2.7. Exchanges

We are happy to exchange an eligible item for a different size, color, or variant, subject to availability. Exchange requests follow the same eligibility conditions and process as returns under this Section. If the replacement item has a different price, the difference will be charged or refunded accordingly.


3. DIGITAL GOODS

3.1. General Rule — All Sales Final. Due to the nature of digital products, all sales of digital goods (including ebooks, PDFs, downloadable archives, or other electronically delivered content) are final and non-refundable once the product has been delivered, downloaded, or the associated access link/code has been issued, except as set out below.

3.2. Exceptions. A refund or replacement for a digital good will be provided where:

(a) The file is corrupted, defective, or does not function as described, and the issue is confirmed upon investigation; or (b) You were charged for a digital product but did not receive delivery or access due to a technical error attributable to the Company.

3.3. Time Limit. Requests under Section 3.2 must be submitted within seven (7) calendar days of purchase, with a description of the issue, to [email protected].

3.4. No Refund for Change of Mind. Because digital goods can be immediately copied and cannot practicably be “returned,” we do not offer refunds for change of mind, incompatibility with a device the buyer failed to verify prior to purchase, or dissatisfaction with editorial content that was accurately described at the time of sale.


4. DEFECTIVE, DAMAGED, OR INCORRECT ITEMS

4.1. If you receive a physical item that is defective, damaged in transit, or different from what you ordered, notify us within seven (7) calendar days of delivery at [email protected], including photographs of the item and its packaging where possible.

4.2. Upon verification, the Company will, at your choice, (a) replace the item at no additional cost, (b) issue a full refund including original shipping charges, or (c) provide store credit, and will cover all associated return shipping costs.

4.3. This Section applies equally to domestic and international orders.


5. INTERNATIONAL ORDERS AND SHIPPING

5.1. The Company ships internationally, including to Venezuela and other countries. International customers should note the following:

(a) Customs, duties, and taxes. Import duties, customs fees, and local taxes assessed by the destination country are the responsibility of the customer and are not included in the item price or shipping cost, unless explicitly stated as “duties paid” at checkout. The Company has no control over these charges and cannot predict their amount.

(b) Delivery times. International delivery times are estimates only and may be affected by customs processing, carrier delays, or local postal conditions outside the Company’s control. The Company is not liable for delays caused by customs authorities, carriers, or force majeure events.

(c) Non-delivery due to customs seizure or refusal. If an international shipment is seized, refused, or destroyed by customs authorities in the destination country, the Company is not responsible for issuing a refund unless the underlying cause was an error by the Company (e.g., incorrect customs documentation prepared by the Company).

(d) Undeliverable/refused packages. If a package is returned to the Company as undeliverable due to an incomplete or incorrect address provided by the customer, or is refused by the recipient, the customer is responsible for the original and return shipping costs. A refund of the product price (excluding shipping) will be issued upon the Company’s receipt of the returned package.

(e) Return shipping from abroad. For change-of-mind returns originating outside the United States, the customer is responsible for return shipping costs and any customs documentation required to avoid duties being assessed on the returned goods. We recommend marking returned packages as “returned merchandise” to minimize customs complications.

5.2. Shipping costs, once paid, are non-refundable except where the return is due to the Company’s error, as described in Sections 2.5(a) and 4.2.


6. SUBSCRIPTIONS AND MEMBERSHIPS

6.1. Billing. If the Site offers a paid subscription or membership (e.g., ad-free access, exclusive content, or a premium newsletter tier), subscriptions automatically renew at the then-current rate at the end of each billing cycle unless cancelled prior to the renewal date.

6.2. Cancellation. You may cancel at any time through your account settings or by contacting [email protected]. Cancellation takes effect at the end of the then-current billing cycle, and you retain access through the period already paid for.

6.3. No Prorated Refunds. Except as required by applicable law, the Company does not provide prorated refunds for partial subscription periods.

6.4. Billing Errors. Report suspected billing errors within thirty (30) days of the charge. Verified errors will be corrected and refunded in full.


7. ADVERTISING AND SPONSORED PLACEMENTS

7.1. Pre-Publication Cancellation. An advertiser may cancel a scheduled placement and receive a full refund if written cancellation notice is received at least seventy-two (72) hours before the scheduled start date.

7.2. After Publication Begins. Once a placement is live, amounts paid are non-refundable, except on a prorated basis for any unfulfilled portion caused solely by the Company’s failure to deliver the agreed placement.

7.3. Content Rejection. If the Company declines to publish submitted advertising or sponsored content for failing editorial or legal standards, the advertiser may submit compliant replacement material or receive a full refund.

7.4. No Guarantee of Results. The Company does not guarantee specific traffic, engagement, or business outcomes from advertising placements. Performance dissatisfaction, absent a documented delivery failure by the Company, does not entitle the advertiser to a refund.

7.5. Paid Press Release / Sponsored Content Placement. Where a journalist, agency, or organization has a separate written agreement with the Company for paid placement (as distinguished from the free editorial courtesy publication described in Section 9 of our Terms and Conditions), refund eligibility is governed by that agreement and, absent contrary terms, by Sections 7.1–7.3 above.


8. DISPUTED CHARGES AND CHARGEBACKS

8.1. Please contact [email protected] to resolve any billing concern before filing a chargeback with your bank or payment provider, to allow for faster resolution.

8.2. Filing a chargeback for a legitimately rendered product or service, without first attempting to resolve the matter with the Company, may result in suspension of your account pending resolution, consistent with our Terms and Conditions.

8.3. The Company reserves the right to contest any chargeback it believes unwarranted by providing evidence of order fulfillment, delivery, or service performance to the relevant payment processor.


9. HOW TO REQUEST A REFUND, RETURN, OR EXCHANGE

9.2. Please include: (a) your full name; (b) order number; (c) date and amount of the transaction; (d) item(s) involved; and (e) the reason for your request, with photos if the item is damaged or defective.

9.3. We will confirm receipt of your request within a reasonable time and aim to process eligible refunds within ten (10) business days of approval. Refunds are issued to the original method of payment, unless otherwise agreed in writing.


10. PAYMENT PROCESSING

10.1. Payments made through the Site’s WooCommerce store are processed by third-party payment gateways (e.g., Stripe, PayPal, or similar processors). The Company does not directly store full payment card details.

10.2. Refund processing times to your bank or card issuer are outside the Company’s control once submitted to the payment processor, and may take additional business days to appear on your statement.

10.3. Currency conversion fees, foreign transaction fees, or bank fees imposed by your financial institution in connection with a purchase or refund — which may commonly apply to international customers, including those in Venezuela — are not the responsibility of the Company.


11. CONSUMER RIGHTS

11.1. Nothing in this Policy limits any non-waivable statutory right you may have under the laws of your jurisdiction of residence, including applicable consumer protection laws. Where such laws grant rights greater than those described here, those laws shall govern to the extent required.

11.2. This Policy is intended to align with applicable U.S. Federal Trade Commission guidance on mail/internet order merchandise rules and automatic-renewal disclosures. If you believe a subscription was enrolled or renewed without clear and conspicuous disclosure and consent, contact us immediately for review.


12. CHANGES TO THIS POLICY

The Company reserves the right to modify this Refunds and Returns Policy at any time. Changes will be reflected by an updated “Last Updated” date above and, where required by law, will not apply retroactively to reduce refund rights already accrued at the time of a prior purchase.
