El derecho de asilo (a veces llamado derecho de asilo político, de la antigua palabra griega ἄσυλον) es un antiguo concepto jurídico, según el cual una persona perseguida por el propio país puede ser protegida por otra autoridad soberana, como otro país o funcionario eclesiástico, quien en la época medieval podía ofrecer santuario. Este derecho ya fue reconocido por los egipcios, los griegos y los hebreos, de quienes fue adoptado en la tradición occidental. René Descartes huyó a los Países Bajos, Voltaire a Inglaterra y Thomas Hobbes a Francia, porque cada estado ofreció protección a los extranjeros perseguidos.
El artículo 14 de la Declaración Universal de los Derechos Humanos dice que “Toda persona tiene derecho a buscar y disfrutar en otros países del asilo de la persecución“. La Convención de las Naciones Unidas de 1951 sobre el Estatuto de los Refugiados y el Protocolo de 1967 sobre el Estatuto de los Refugiados orientan la legislación nacional relativa al asilo político.
